By visiting our site, registering for an account, and/or using our Service (including generating designs), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site and Service, including without limitation users who are browsers, subscribers, customers, and/or contributors of content or input materials.

You require an account and a paid subscription (as applicable) to access core features of the Service. You agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

You may not use our Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright and intellectual property laws). This includes providing input materials (like images) that you do not have the right to use.

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

SECTION 3 – SERVICE DESCRIPTION & AI-GENERATED CONTENT

EffortlessPOD provides a subscription-based online tool that generates AI-generated designs primarily intended for print-on-demand purposes.

The Service utilizes APIs and technology from third-party providers (e.g., other AI model providers) to generate designs based on user inputs (text prompts, images).

The Service can generate new images based on images you provide (“image-to-image”). These generated images are inspired by the input but are not intended to be exact copies. You must ensure you have the necessary rights to use any images you provide as input.

AI Output: You acknowledge that designs generated by the Service (“Output”) are created by artificial intelligence. While we strive for high-quality results, the Output may contain errors, inaccuracies, or artifacts. Output may not be unique, and other users may generate similar or identical designs.

Intellectual Property of Output: Subject to your compliance with these Terms, and particularly your rights to any input materials you provide, EffortlessPOD grants you a license to use the Output you generate via the Service for your personal or commercial print-on-demand purposes. You are responsible for ensuring the Output is suitable for your intended use and does not infringe on any third-party rights (e.g., trademarks existing in the generated design). EffortlessPOD retains ownership of the underlying Service, technology, and models.

SECTION 9 – REFUND POLICY

General Policy

Due to the nature of our digital Service and the instant access provided upon subscription activation, payments made for EffortlessPOD subscriptions are generally non-refundable. Once a subscription fee is paid and the service period begins, you will retain access for the duration of the paid period, but no refunds or credits will typically be issued for partial subscription periods, cancellations, or non-use.
